HW-10 Home Protection Policy

EXCLUSIONS

  1. insect damage
  2. personal property or bodily damage
  3. incomplete construction of home
  4. normal wear and tear/deterioration
  5. damage to anything in the home which was not covered in its original purchase price
  6. landscaping-sodding, seeding, plantings, shrubs and trees except damage caused by debris or materials not removed by the contractors or builder that constructed the home
  7. swimming pools and other recreational facilities, or any improvement(s) which are not a part of the home itself
  8. driveways, walkways, sidewalks, patios, decks, fences, bulkheads, boundary walls and retaining walls, unless they directly affect or threaten to affect the dwelling itself
  9. out-buildings, including detached garages and carports, except for detached building(s) which house equipment for heating/cooling or ventilation, plumbing and electrical systems which serve the home
  10. any problem associated with any material or work not supplied or done on or before the date when coverage hereunder begins
  11. damage or loss caused or exacerbated by a Homeowner's failure to timely notify HW10 of a potential or pending problem
  12. damage caused by soil subsidence for which other compensation is provided to the Homeowner
  13. any problem wit the home which occurs when the home is being used for nonresidential purpose
  14. any problem which is not a cause of physical damage to the home, including, but not limited to, uninhabitability or health risk due to the presence or consequence of unacceptable levels of radon gas, formaldehyde or other pollutants or contaminants, or of hazardous or toxic materials on or off site
  15. problems caused by acts of God, lightning, windstorms, hail, flood, mud slide, wind-driven water, earthquake, changes in underground water table, riot, civil commotion, fire, explosion, smoke, water escape, aircraft, falling objects, vehicles, accidents or intentional acts of others
  16. any damage caused or made worse by:
    1. any change or addition or alteration to the home after the commencement date of policy
    2. grading changes made by the homeowner or its agents after the date of policy
    3. condensation and dampness problems caused by homeowner neglect in maintaining proper ventilation in the home
    4. failure of homeowner to properly inform HW10 of defects within a reasonable time frame, or failure of homeowner to take timely action to minimize damages
    5. improper operation, maintenance or negligence by anyone other than HW10
    6. improper compliance with manufacturer's warranty requirements on equipment, appliances and fixtures by anyone other than HW10
  17. cost of food, shelter, transportation, storage, moving or other incidental costs related to moving
  18. All consequential damages which may result from a claim filed pursuant to this policy are expressly excluded from the terms of this policy. Consequential damages include, but are not limited to, the cost of food, shelter, transportation, storage, moving or other such incidental costs related to moving, should homeowner vacate the residence. Consequential damages which are hereby excluded from this policy contemplate expenses other than those enumerated in this section. It is a legal term and should you have any doubts as to the scope of this exclusion, consult an attorney.
  19. loss or damage due to abnormal or excessive loading on floors by homeowner which exceeds the design loads and mandated by City/States codes
  20. loss or damage caused by, or resulting from, water leaks, water seeps, or from high humidity
